GENERAL TERMS AND CONDITIONS
1. Scope of application
The following General Terms and Conditions apply to all orders placed via our online shop. Our online shop is intended solely for consumers.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his/her commercial nor his/her self-employed activity. Entrepreneur is a natural or legal person or a partnership with legal capacity that acts in a commercial or independent professional capacity when concluding a legal transaction.

2. Contracting party, conclusion of contract, option to adjust
The sales contract is concluded with Frummi | KNS GmbH.
By making products available in the online shop, we make a binding offer to conclude a contract for these products. You can provisionally place products in the shopping cart without incurring any obligation and, by using the adjustment tools provided and explained in the order process, can adjust the contents of your shopping cart at any time before submitting your binding order. The contract is concluded when you click on the order button to accept the offer of the goods contained in the shopping basket. Immediately after sending your order, you will receive confirmation via email.

3. Contract language, contract text storage
The language used for the conclusion of the contract is German.
We save the text of the contract and will send you your order details and our general terms and conditions via email. For security reasons, the contract text is no longer accessible on the Internet.

4. Terms of delivery
Delivery within Germany is free of charge.
We deliver only via dispatch. You cannot collect products yourself and we do not deliver to packing stations.

5. Payment
The following payment methods are available:
Credit card

When you place your order, you also send us your credit card details. After your verification as the legitimate cardholder, we ask your credit card company to initiate payment immediately after the order has been placed. Payment is carried out automatically by the credit card company and your card is debited.

PayPal, PayPal Express
During the ordering process you will be redirected to the website of the online provider PayPal. To be able to pay the invoice via PayPal, you must be registered there, verify your access data and confirm the payment order. After you have placed your order, we ask PayPal to initiate payment. Immediate payment will then be carried out automatically by PayPal. You will receive further information during the ordering process.

PayPal Plus
We offer you various payment methods as part of the PayPal Plus payment service. You will be taken to the website of the online provider PayPal. There you can enter your payment data and confirm the use of your data by PayPal and the payment order to PayPal.

If you have chosen to pay via PayPal, you have to be registered with PayPal and verify your access data. Payment is executed automatically by PayPal after you conform the payment order. You will receive further information during the ordering process.

If you have chosen to pay via credit card, you do not have to be registered with PayPal. Payment transaction will be processed by your credit card company at PayPal’s request immediately after you confirm the payment order and you are verified as the legitimate cardholder. Your card will then be debited. You will receive further information during the ordering process.

If you have chosen to pay via direct debit, you do not need to be registered with PayPal. By confirming your payment order, you give PayPal a direct debit mandate. PayPal will inform you of the date your account is to be debited (pre-notification). By submitting the direct debit mandate immediately after conformation of payment order, PayPal requests its bank to initiate payment. Payment will be executed and your account will be debited. You will receive further information during the ordering process.

If you have chosen to pay via invoice, you do not have to be registered with PayPal. Following verification of address, credit check and submission of order, we assign our claim to PayPal. In this case payment with discharging effect can only be made to PayPal. For payment processing via PayPal, PayPal’s general terms and conditions and privacy policy shall apply in addition to our general terms and conditions. Giropay
After placing your order you will be redirected to the website of your bank. In order to be able to pay via Giropay, you must have an online bank account (with PIN/TAN procedure) that has been approved for Giropay transactions and you must verify your identity and confirm your payment order. Further information will be provided during the ordering process. Payment is carried out immediately afterwards and your account will be debited accordingly.

6. Reservation of title
The goods remain our property until full payment has been made.

7. Transport damage
If goods with obvious transport damage are delivered, please immediately notify the deliverer and us. Failure to do so will not affect your rights, especially your warranty rights, but such notification will enable us to assert our own rights against the carrier and claim on our insurance.

8 Warranty and guarantees
Unless expressly agreed otherwise below, statutory liability for defects shall apply.
In the case of used goods, if the defect occurs later than one year after delivery, claims for defects are excluded. Defects that occur within one year of delivery can be claimed for within the statutory limitation period of two years from delivery.
The aforementioned restrictions and deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
– in the event of injury to life, limb or health
– in the event of intentional or grossly negligent breach of duty or fraudulent intent
– in the event of breach of material contractual obligations, the performance of which is essential for the proper performance of contract and on the observance of which the contractual partner ought regularly to be able to rely (cardinal obligations)
– within the framework of a guarantee, if agreed, or
– to the extent that the scope of application of the Product Liability Act applies.

9. Liability
For claims due to damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation
– in the event of injury to life, limb or health
– in the event of intentional or grossly negligent breach of duty
– in the event of guarantee promises, if agreed, or
– to the extent that the scope of application of the Product Liability Act applies.
In the event of breach of cardinal obligations due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which is typically to be expected.
Otherwise, claims for damages are excluded.

11. Dispute resolution
The European Commission provides a platform for online dispute resolution, which can be found here.
